These Terms of Service ("Terms") govern your use of the Easy Baby Tracker mobile application and related services (together, the "Service") provided by BabyEase ("we", "us", or "our"). By downloading, accessing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service helps parents and caregivers log and review baby care activities (such as feeding, sleep, and diapers), schedules, and related features. Some features may require creating an account or purchasing a paid plan. We may update, modify, or discontinue parts of the Service with reasonable notice where appropriate.
You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You must provide accurate information. If you use the Service on behalf of a child, you represent that you are the parent or legal guardian (or have their authorization) and accept these Terms on their behalf where applicable.
Certain features are offered as auto-renewing subscriptions or one-time purchases through Apple's App Store or Google Play. Prices, billing periods, and available products are displayed in the app and in your store account at the time of purchase.
We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service in line with these Terms and the usage rules of the platform from which you obtained the app. You agree not to misuse the Service, including by attempting to access others' data without permission, reverse engineer the app except as permitted by law, or use the Service for unlawful purposes.
The Service, including its design, text, graphics, and software, is owned by BabyEase or its licensors and is protected by intellectual property laws. Except for the limited license above, no rights are granted to you.
Our collection and use of personal information is described in our Privacy Policy. By using the Service, you acknowledge that you have read that policy.
The Service is provided "as is" and "as available". It is not medical advice, diagnosis, or treatment. Always consult a qualified health professional for medical questions. To the maximum extent permitted by law, we disclaim warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the extent permitted by law, BabyEase shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of the Service. Our total liability for any claim relating to the Service shall not exceed the greater of (a) the amount you paid us in the twelve (12) months before the claim or (b) fifty U.S. dollars (US$50), except where liability cannot be limited by applicable law.
We may update these Terms from time to time. We will post the updated Terms on this page and revise the "Last updated" date. Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms, except where applicable law requires a different process.
If you obtained the app from Apple's App Store, you acknowledge that these Terms are between you and BabyEase only, not Apple. Apple has no obligation to furnish maintenance or support for the app. Apple is not responsible for addressing claims relating to the app or your use of it. In the event of a failure to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price where required; to the maximum extent permitted by law, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce the applicable provisions against you.
